Jurisprudential-Legal Analysis of Photography/Recording of Flagrant and Non-Flagrant Crimes

Abstract
One of the jurisprudential questions in the field of social jurisprudence is the subject of recording crimes, whether flagrant or non-flagrant. This issue has become more prominent in recent years, particularly regarding improper hijab and lack of hijab, vehicle violations, public fasting violations, and other religious and legal violations. Therefore, from a jurisprudential and legal perspective, the question arises whether citizens can record the crimes of other members of society? In this writing, using descriptive-analytical method and library sources, this subject has been analyzed from jurisprudential and legal aspects, and considering the possibility of applying various titles to the act of recording crime - such as spreading indecency, violating believer's privacy, destroying their reputation, commanding good and forbidding evil, self-defense in judicial courts, etc. - the application of each of these titles to others has been analyzed and it has been proven that if recording others' crimes is an instance of one of the above titles, the ruling of that title applies to it; but if it is an instance of multiple titles, their rulings conflict with each other and one must refer to the principles of conflict resolution.
