Analysis of Ayatollah Khoi's Detailed Opinion on the Ruling of Khums on Excess Wealth Obtained from Non-Business and Non-Trade Sources

Abstract
Unlike most jurists, Muhaqqiq Khoi has made a distinction in the ruling of khums between property that a person owns without exchange and property acquired through exchange or transaction. In cases where property is obtained through donation or revival, he states: In reality, a person becomes the owner of the financial value of that commodity, and this value is not limited to a specific amount. Consequently, if the commodity is sold, the increase in its price is not considered an increase in capital that would necessitate khums. However, if a property is purchased, the capital is defined, and if it is sold for a higher price, khums must be paid on the price increase. Now, if property is acquired through means other than exchange and its market value subsequently increases, does the concept of profit and benefit apply to this increase or not? This article, using a descriptive method and library sources, reveals that Ayatollah Khoi's reasoning for his claim is that profit and gain are generated for a person who becomes an owner through exchange, and consequently, khums becomes obligatory. However, for a person who becomes an owner through non-exchange means, since no price has been paid, the increase in the value of that property does not constitute an increase in capital, and therefore, khums will not become obligatory.
