Legitimacy of Paternal Guardianship of the Sperm Owner Derived from Stem Cells over the Child Born from Artificial Insemination

Abstract
One of the important issues in the field of infertility treatment using sperm derived from stem cells is the position of paternal guardianship, with all its effects, over a child born through this method. This research, using an analytical and critical approach and referring to library sources, has examined the legitimacy of paternal guardianship over a newborn derived from stem cells. Given that it has been scientifically proven that the origin of child creation from the male side is the sperm in the individual's semen, and custom and language also consider the criterion to be the customary attribution of the child to the owner of the sperm, he is considered the guardian of the child. However, in this article, two assumptions can be envisioned: the marital relationship between the stem cell owner from which the sperm was obtained and the egg owner, and the absence of a marital relationship. In the first case, assuming the attribution of sperm to the stem cell owner is accepted, the attachment of the newborn to him is not inherently problematic from a religious perspective, and thus his guardianship over the newborn is established. In the second case, assuming the attribution of sperm to the stem cell owner is accepted, the newborn will customarily be attached to his biological father, and therefore his guardianship over the child resulting from stem cells will also be religiously established.
