Critique and Analysis of the Jurisprudential Reasons for Reducing Compensation in Traffic Accidents Subject to Notes 3 and 4 of Article 8 of the Compulsory Insurance Law

Abstract
The legislator, to determine the duty in cases where the perpetrator of the accident in traffic accidents is unable to compensate, has reduced the legal liability in notes 3 and 4 of Article 8 of the Compulsory Insurance Law. In the present study, using library resources and a descriptive-analytical method, after presenting the existing reasons such as the principles of no harm and waste (Etlaf), cases that may be considered as reasons against it, such as the principle of action (Qaedeh Eqdam), the financial situation of the perpetrator of the accident and the victim of the accident were examined with the aim of critiquing and analyzing the jurisprudential reasons for reducing compensation in traffic accidents regarding the subject of notes 3 and 4 of Article 8 of the Compulsory Insurance Law. The authors have come to the conclusion that in Imami jurisprudence, the financial situation has not been a criterion for determining compensation. Even if a jurist does not accept full compensation, they have accepted its full payment based on other reasons such as the principle of waste and consider it unquestionable. Therefore, reducing the compensation to the victim in traffic accidents is not consistent with jurisprudential principles or even legal provisions. Ultimately, in case of the perpetrator's insolvency, installment compensation or deferment (Emhal) until solvency, or payment of compensation from other sources should be considered, not reducing the amount of compensation to the victim of the accident.
