Therefore, controlling patients' behavior, restricting them and thus preventing pandemic in the community is one of the important issues in the field of medicine. In this regard, one of the strategic measures in disease control is to pay attention to civil-criminal liability and the guarantee issues raised by the transmission of this type of diseases. Accordingly, the coming question is that according to the religious teachings, if the duties of citizenship are not observed and the contagious disease is transmitted to others, what are the responsibilities of the transmitter? Will there be any guarantee to the transmitter due to the damages he causes by the disease transmission? Although it seems certain to compensate for the documented damage by the transmitter of the disease, but problems such as: the fatality of the disease, the knowledge and ignorance of the parties to the infection bring about some difficulties in obtaining, documenting and proving the type of  responsibility and the resulted guarantee. Therefore, in the present article, employing the analytical method and using library sources different forms of transmission are studied, concluding that if a person is aware of his disease and its fatality and deliberately causes another's death by transmitting the disease, his action is view of Master Javādi Āmoli on the role and contribution of reason in this field.}, keywords = {Reason,the Role of Reason,Principles of Jurisprudence,the foundation of rationalists,structural reform,Allāmeh Javādi Āmoli}, title_fa = {بررسی فقهی ضمان ناشی از انتقال بیماری مسری}, abstract_fa = {شیوع بیماری‌های واگیردار با ماهیتی نوعاً کشنده تهدیدی علیه امنیت سلامت شمرده می­شوند؛ بنابراین کنترل رفتار بیماران، محدودسازی آنها و در نتیجه جلوگیری از انتشار آن در میان افراد جامعه، از مسائل مهم حوزة پزشکی است. در این راستا یکی از تدابیر راهبردی در کنترل بیماری، توجه دادن به مسئولیت مدنی ـ کیفری و ضمان‌آور بودن انتقال این نوع از بیماری­هاست. بر این اساس پرسش پیش‌رو آن است که در آموزه­های دینی، در صورت رعایت نکردن وظایف شهروندی و انتقال بیماری مسری به دیگران چه مسئولیت‌هایی متوجه فرد ناقل است؟ آیا ضمانتی در قبال خسارت­های ناشی از بیماری متوجه فرد انتقال‌دهنده خواهد بود؟ به نظر می‌رسد اگرچه جبران خسارت‌های مستند به انتقال‌دهندة بیماری، امری مسلّم به شمار می­رود؛ اما ویژگی­هایی مانند میزان کشندگی بیماری، علم و جهل طرفین از آلودگی، دشواری­هایی را در احراز، استناد و اثبات نوع مسئولیت و ضمان حاصل از آن پدید آورده است؛ از این‌رو در نوشتار حاضر به روش تحلیلی ـ اجتهادی و با بهره‌گیری از منابع کتابخانه­ای به بررسی حالت‌های گوناگون انتقال پرداخته است و نتیجه آن شد که اگر فرد از بیماری خود و کشندگی آن آگاهی داشته باشد و عمداً با انتقال بیماری موجب فوت دیگری شود، از عملکرد وی با عنوان قتل عمد یاد می‌شود و سزاوار قصاص است و در مواردی که بیماری کشنده نباشد و منجر به قتل شود، شبه‌عمد است و محکوم به پرداخت دیه خواهد بود و در نهایت اگر شخص از بیماری خود آگاهی نداشته باشد و با انتقال موجب فوت دیگری شود، عمل او خطای محض به شمار می­رود که ضمان آن بر عهدة عاقله است.}, keywords_fa = {بیماری مسری,سرایت,ضمان,استناد}, url = {https://mags.markazfeqhi.com/article_243709.html}, eprint = {https://mags.markazfeqhi.com/article_243709_f1d623d21d43b15a353c700ce068a60d.pdf} }
